The article asks how phenomenology, understood as a philosophical method of investigation, can account for gender. Despite the fact that it has provided useful tools for feminist inquiry, the question remains how gender can be studied within the paradigm of a philosophy of a subject. The article explicates four different understandings of phenomenology and assesses their respective potential in terms of theorizing gender: a classical reading, a corporeal reading, an intersubjective reading and a post-phenomenological reading. Grotius is now widely acknowledged as an important figure in early modern contractual and consensual theories of political authority and legitimacy. However, as his thoughts on these debates are disseminated throughout his works rather than systematically ordained, it remains difficult to assess what, if anything, constitutes his distinctive mark. In the present paper, I will argue that his works contain a combination of two conceptual elements that have come to constitute a salient characteristic of early modern contract and consent theories: (...) first, a strong obligation to keep one’s promises, and second, an account of perfect promises as transferrals of rights. In the political sphere, this means that citizens who have promised their obedience to the authorities are obligated to keep faith, which provides a solid foundation for political obligations. In addition, their promise implies that authorities receive the right to rule over them, which accounts for the legitimacy of these authorities’ power. (shrink)

Moloney, Francis J Jesus' teaching on divorce is a question of central importance to the Christian churches. The ministry of Pope Francis, and the agenda of the Synod of Bishops on the Family, has again drawn attention to the issue. Given the paucity of material on marriage and divorce in the entire Bible, it is not surprising that very little material in the New Testament is dedicated to Jesus' attitude to the issue. But what is found in Paul, Mark, (...) Matthew and Luke is confronting to contemporary sensitivities, and calls for clear analysis. An uncritical affirmation that Jesus prohibited divorce does not do justice to what is recalled in our inspired Scriptures. The fact that he did so must be given its due importance, but Jesus' prohibition of divorce and remarriage is not the only word on marriage and divorce in the pages of the New Testament. A neglect of the subtleties expressed across the pastoral and theological reinterpretations of Paul, Mark, and Matthew, accepted by the church as the inspired Word of God, call for close attention. Moloney, Francis J In 1996 the American sociologist, Rodney Stark, published a provocative sociological study called The Rise of Christianity. He wrote this book because his reading of the work of the historians of early Christianity showed that their history was good, but their sociology was nonexistent. He minimalised many theories about the rise of Christianity. Theologians and church historians regularly point to the transforming effect of the purity of the doctrine, the teaching of the resurrection, the blood of (...) the martyrs, a sacramental life, and other such central Christian beliefs and phenomena as the reasons for its rapid spread in the Roman Empire. Stark questions this, insisting that the fundamental motivation for the phenomenon was that the Christians cared for one another, especially their women. (shrink)

Ontic structural realists hold that structure is all there is, or at least all there is fundamentally. This thesis has proved to be puzzling: What exactly does it say about the relationship between objects and structures? In this article, I look at different ways of articulating ontic structural realism in terms of the relation between structures and objects. I show that objects cannot be reduced to structure, and argue that ontological dependence cannot be used to establish strong forms of structural (...) realism. At the end, I show how a weaker, but controversial, form of structural realism can be articulated on the basis of ontological dependence. (shrink)

Die Techniken der Vermittlung werden untersucht, um den Zusammenhang zwischen Recht und Vermittlung zu erhellen, der in einem nicht risikolosen Alternativverhältnis besteht. The contribution focuses upon mediation as an alternative means to (...) resolve conflicts. Considering the interdependence between law and literature, it relates legal norms and institutions of mediation, e.g. amicable settlements or conciliatory proceedings, to the literary figure of the female judge and mediator, especially Athena in Aeschylus's. In 1970, exactly fifty years ago, I took entrance examinations in Hebrew and Greek to begin studies at the Pontifical Biblical Institute, Rome. I have shared in various ministries since then, sometimes in positions that distracted from my academic interests. Nevertheless, I have been a privileged 'insider' to the development of critical studies of the New Testament over the past fifty years. The way Ernst Cassirer understands Jean-Jacques Rousseau at the beginning of the 1930’s is interesting, in so far as it puts forward different mechanisms of interpretation, which Cassirer is not always conscious of. On the one hand, Cassirer claims to have a fresh and neutral interpretation of Rousseau’s works, going above divergent contemporaneous interpretations. On the other hand, his thought is actually determined by his personal philosophical formation, that is to say the neokantism of the Marburg School, and above all (...) by the political context. There is a well-known tension within Sellars' scheme arising from commitments to both an anti-foundationalist epistemology and a Peircean scientific realism. This tension surfaces conspicuously in his treatment of ontological category theory. On the one hand, Sellars applies and extends Carnap's metalinguistic deflation of ontology. On the other hand, however, Sellars is not prepared to 'go conventionalist' but upholds the possibility of a "positive ontology" (Rosenberg). I offer a new reading of Sellars’ Carus Lectures in which I combine two projects. (...) First, I argue that Sellars provides us here with the sketch of a method of ‘category projection’ which can be used, within the setting of Sellars' scheme, to 'transcend from within' the limitations of category theories developed in non-Peircean conceptual structures and to enable us non-Peirceans to make any justifiable descriptive claims about the structure of reality. In the course of doing so I also offer a new reading of Sellars' Carus Lectures, highlighting the systematic advantages that motivated Sellars to view a process ontological interpretation of sensation. In her Choosing Well, Chrisoula Andreou puts forth an account of instrumental rationality that is revisionary in two respects. First, it changes the goalpost or standard of instrumental rationality to include “categorial” appraisal responses, alongside preferences, which are relational. Second, her account is explicitly diachronic, applying to series of choices as well as isolated ones. Andreou takes both revisions to be necessary for dealing with problematic choice scenarios agents with disorderly preferences might find themselves in. Focusing on problem cases involving (...) cyclical preferences, I will first argue that her first revision is undermotivated once we accept the second. If we are willing to grant that there are diachronic rationality constraints, the preference-based picture can get us further than Andreou acknowledges. I will then turn to present additional grounds for rejecting the preference-based picture. However, these grounds also seem to undermine Andreou’s own appeal to categorial appraisal responses. Some scientists are happy to follow in the footsteps of others; some like to explore novel approaches. It is tempting to think that herein lies an epistemic division of labor conducive to overall scientific progress: the latter point the way to fruitful areas of research, and the former more fully explore those areas. Weisberg and Muldoon’s model, however, suggests that it would be best if all scientists explored novel approaches. I argue that this is due to implausible modeling choices, and (...) Risk-weighted expected utility theory is motivated by small-world problems like the Allais paradox, but it is a grand-world theory by nature. And, at the grand-world level, its ability to handle the Allais paradox is dubious. The REU model described in Risk and Rationality turns out to be risk-seeking rather than risk-averse on one natural way of formulating the Allais gambles in the grand-world context. This result illustrates a general problem with the case for REU theory, we argue. There is a (...) tension between the small-world thinking marshaled against standard expected utility theory, and the grand-world thinking inherent to the risk-weighted alternative. (shrink)

The paper traces, historically and systematically, the influence of Carnap’s philosophical program on the writings of Nelson Goodman, focusing on the relationship between Carnap’s Aufbau and Goodman’s Structure of Appearance. In particular, drawing on unpublished material from the Carnap Research Archives, I show that Carnap had already anticipated Goodman’s criticism of the method of quasi-analysis and that Goodman misconstrued the status of this procedure on several counts. I also argue that Carnap’s anti-metaphysical stance left his approach with an explanatory deficit (...) which Goodman’s pragmatist pluralism is able to address. (shrink)

This article presents two related challenges to the idea that, to ensure policy evaluation is comprehensive, all costs and benefits should be aggregated into a single, equity-weighted wellbeing metric. The first is to point out how, even allowing for equity-weighting, the use of a single metric limits the extent to which we can take distributional concerns into account. The second challenge starts from the observation that in this and many other ways, aggregating diverse effects into a single metric of evaluation (...) necessarily involves settling many moral questions that reasonable people disagree about. This raises serious questions as to what role such a method of policy evaluation can and should play in informing policy-making in liberal democracies. Ultimately, to ensure comprehensiveness of policy evaluation in a wider sense, namely, that all the diverse effects that reasonable people might think matter are kept score of, we need multiple metrics as inputs to public deliberation. Freedom and the subject were guiding themes for Michel Foucault throughout his philosophical career. In this clear and comprehensive analysis of his thought, Johanna Oksala identifies the different interpretations of freedom in his philosophy and examines three major divisions of it: the archaeological, the genealogical, and the ethical. She shows convincingly that in order to appreciate Foucault's project fully we must understand his complex relationship to phenomenology, and she discusses Foucault's treatment of the body in relation to recent feminist (...) work on this topic. Her sophisticated but lucid book illuminates the possibilities that Foucault's philosophy opens up for us in thinking about freedom. (shrink)

The paper presents some essential heuristic and constructional elements of Free Process Theory (FPT), a non-Whiteheadian, monocategoreal framework. I begin with an analysis of our common sense concept of activities, which plays a crucial heuristic role in the development of the notion of a free process. I argue that an activity is not a type but a mode of occurrence, defined in terms of a network of inferences. The inferential space characterizing our concept of an activity entails that anything which (...) is conceived of as occurring in the activity mode is a concrete,dynamic, non-particular individual. Such individuals, which I call free processes, may be used for the interpretation of much more than just common sense activities. I introduce the formal theory FPT, a mereology with anon-transitive part-relation, which contains a typology of processes based on the following five parameters relating to: (a) patterns of possible spatial and temporal recurrence (automerity); (b) kinds of components (participant structure); (c) kinds of dynamic composition; (d) kinds of dynamic flow (dynamic shape); and (e) dynamic context. I show how these five evaluative dimensions for free processes can be used to define ontological correlates for various common sense categories,and to draw distinctions between various forms of agency(distributed, collective, reciprocal, entangled) and emergence (weak, strong,as autonomous system (Bickhard/Christensen)). Processes constitute the world of human experience - from nature to cognition to social reality. Yet our philosophical and scientific theories of nature and experience have traditionally prioritized concepts for static objects and structures. The essays collected here call for a review of the role of dynamic categories in the language of theories. They present old and new descriptive tools for the modelling of dynamic domains, and argue for the merits of process-based explanations in ontology, cognitive science, semiotics, linguistics, philosophy (...) of mind, robotics, theoretical biology, music theory, and philosophy of chemistry and physics. The collection is of interest to professional researchers in any of these fields; it establishes - for the very first time - crossdisciplinary contact among recent process-based research movements and might witness a conceptual paradigm shift in the making. A growing number of decision theorists have, in recent years, defended the view that rationality is permissive under risk: Different rational agents may be more or less risk-averse or risk-inclined. This can result in them making different choices under risk even if they value outcomes in exactly the same way. One pressing question that arises once we grant such permissiveness is what attitude to risk we should implement when choosing on behalf of other people. Are we permitted to implement any (...) of the rationally permissible risk attitudes, is there some specific risk attitude that is required when choosing for others, or are we required to defer to the risk attitudes of the people on whose behalf we are choosing? This article elaborates on this question, explains its wider practical and theoretical significance, provides an overview of existing answers, and explores how to go about providing a more systematic account of how to choose on behalf of others in risky contexts. Taking multidimensional ethics scale approach, this article describes an empirical survey of top managers’ moral decision-making patterns and their change from 1994 to 2004 during morally problematic situations in the Finnish context. The survey questionnaire consisted of four moral dilemmas and a multidimensional scale with six ethical dimensions: justice, deontology, relativism, utilitarianism, egoism and female ethics. The managers evaluated their decision-making in the problems using the multidimensional ethics scale. Altogether 880 questionnaires were analysed statistically. It is concluded that relying on (...) the utilitarian principles is a core ethical evaluation criterion amongst top business managers in Finland. This study proves that managers’ moral decision-making patterns change over time. According to the results of this research, managers’ moral decision-making became more multidimensional during the study period. The change is explained by the inclusion of female ethics items in the scale which allows managers to show more diversity in their decision- making, the change in the Finnish economic context from depression to economic prosperity and growth during the study period, which is conducive to the spread of post materialist values, such as the importance of social relations and the increasing public discussion of the importance ethical issues in business. General Process Theory (GPT) is a new (non-Whiteheadian) process ontology. According to GPT the domains of scientific inquiry and everyday practice consist of configurations of ‘goings-on’ or ‘dynamics’ that can be technically defined as concrete, dynamic, non-particular individuals called general processes. The paper offers a brief introduction to GPT in order to provide ontological foundations for research programs such as interactivism that centrally rely on the notions of ‘process,’ ‘interaction,’ and ‘emergence.’ I begin with an analysis of our common sense (...) concept of activities, which plays a crucial heuristic role in the development of the notion of a general process. General processes are not individuated in terms of their location but in terms of ‘what they do,’ i.e., in terms of their dynamic relationships in the basic sense of one process being part of another. The formal framework of GPT is thus an extensional mereology, albeit a non-classical theory with a non-transitive part-relation. After a brief sketch of basic notions and strategies of the GPT-framework I show how the latter may be applied to distinguish between causal, mechanistic, functional, self-maintaining, and recursively self-maintaining interactions, all of which involve ‘emergent phenomena’ in various senses of the term. This article argues that Lara Buchak’s risk-weighted expected utility (REU) theory fails to offer a true alternative to expected utility theory. Under commonly held assumptions about dynamic choice and the framing of decision problems, rational agents are guided by their attitudes to temporally extended courses of action. If so, REU theory makes approximately the same recommendations as expected utility theory. Being more permissive about dynamic choice or framing, however, undermines the theory’s claim to capturing a steady choice disposition in the (...) face of risk. I argue that this poses a challenge to alternatives to expected utility theory more generally. (shrink)

Les comportements individuels et collectifs en présence d’incertitude peuvent paraître irrationnels ou se modifier au cours du temps à la suite de nouvelles informations ou d’événements plus ou moins en lien avec ces incertitudes. Ceci pose la question des moyens mis à disposition des autorités publiques pour prévenir et gérer ces situations. Dans cet article, nous nous intéressons aux comportements des individus face aux situations incertaines en mettant en avant la manière dont la population peut percevoir ces incertitudes et les (...) informations provenant de sources diverses. Nous reprenons la littérature économique des comportements et prises de décision dans un environnement incertain afin de mettre en évidence les difficultés de la mise en place de politiques notamment d’incitation à la prévention.
